There are certain steps that one should take when a Protection from Abuse complaint is filed against them. The Court may grant temporary orders for Plaintiffs. If the temporary order is granted, a court date will be scheduled.
Once you are served the complaint, it is important to read the complaint and determine who is included within the order. Sometimes children are also included in the temporary order. If children are included, child custody schedules will have to be modified.
If you currently live with the person who filed the complaint, you will be excluded from the shared residence. You will have to find a place to live until the hearing. If you are found guilty, then you will be excluded from the shared residence for 2 years.
If a guilty order is determined by the Court, you must not be in contact with the Plaintiff. If you are found in contempt of the Order, you can be criminally charged.
